In today’s increasingly mobile society, the desire or need to relocate with children following divorce has generated frequent disputes that tend to be difficult to resolve by agreement. Most custody orders in Texas include “domicile restrictions,” or limitations regarding where a parent may live with the children. In Collin County, the most common terms require a parent to live within Collin County or any county sharing a border with Collin County. When May A Parent Move Away With The Children After Divorce?

Generally, courts are not inclined to permit a parent to move away with the children so long as the other parent remains in the area. It is very difficult and expensive to maintain a meaningful long-distance parent-child relationship. Nevertheless, there may be compelling circumstances that would justify such a move. Each case must be considered on its own merits, but the following scenarios may be persuasive:

  • The custodial parent has been unable to find adequate employment within the limited area, despite his or her most diligent efforts.
  • The custodial parent has received a very good job offer outside the limited area that will improve the lives of the children and the family as a whole.
  • The noncustodial parent does not regularly exercise his or her visitation with the children.
  • The ability of the custodial parent to properly care for the children depends on the assistance of family members who live outside the limited area.
